TERMS & CONDITIONS

  1. Introduction
    By purchasing a warranty plan or using our services, you agree to abide by these Terms and Conditions. Please read them carefully, as they outline your rights, obligations, and limitations under our warranty agreements. If you do not agree to these terms, you must refrain from using our services.
  2. Definitions
  • “Company” refers to American Cart Care.
  • “Customer” refers to the individual or business purchasing a warranty plan from the Company.
  • “Warranty” refers to the protection plan purchased to cover golf cart repairs, part replacements, and associated labor costs as outlined in the coverage details.
  • “Covered Components” refer to the specific parts and systems of a golf cart that are eligible for coverage under the warranty plan.
  • “Claim” refers to a formal request by a customer to have a repair, part replacement, or service covered under the warranty plan.
  1. Warranty Coverage
    The warranty coverage provided by American Cart Care Company applies to electric and gas-powered golf carts, as well as Neighborhood Electric Vehicles (NEVs), as specified in the coverage plan you select. Coverage includes, but is not limited to, protection for:
  • Motors and controllers
  • Batteries and electrical components
  • Mechanical parts and essential components
  • Brakes, drive systems, and steering components

Coverage is subject to specific exclusions and limitations, which are outlined in Section 6 of these terms. Coverage is only valid if the customer has an active warranty plan and all payments are up to date.

  1. Eligibility for Coverage
    To be eligible for coverage, the following conditions must be met:
  1. The golf cart must be properly maintained according to the manufacturer’s recommendations.
  2. Claims must be submitted within the warranty period.
  3. The warranty plan must be active at the time of the incident.
  4. Any modifications made to the golf cart without prior approval may void the warranty.

If eligibility criteria are not met, the Company reserves the right to deny claims.

  1. Filing a Claim
    To file a claim, customers must:
  1. Contact our claims department via phone or email to initiate the claims process.
  2. Provide a detailed description of the issue, including the date, location, and nature of the breakdown.
  3. Submit supporting documentation, such as photos, receipts, or maintenance records, if applicable.
  4. Follow any instructions provided by the Company to facilitate the repair or replacement of parts.

The Company will review the claim and notify the customer of the decision within a reasonable timeframe. Approved claims will be processed promptly, and repair or replacement services will be arranged accordingly.

  1. Exclusions and Limitations
    While we provide Exclusionary coverage, certain items and circumstances are not covered under our warranty plans. These include but are not limited to:
  • Normal wear and tear (e.g., tires, bulbs, upholstery, or cosmetic damages)
  • Neglect or misuse (e.g., improper storage, failure to follow manufacturer maintenance guidelines)
  • Unauthorized modifications to the golf cart or NEV
  • Damage from natural disasters (e.g., floods, fires, earthquakes)
  • Incidents caused by accidents, vandalism, or theft
  • Repairs performed without prior authorization from the Company

  1. Cancellation and Refund Policy
    Customers may cancel their warranty plans within a specific period after purchase, often referred to as the “cooling-off period.” Our cancellation policy is as follows:
  • Cancellation within 30 days: Full refund, provided no claims have been filed.
  • Cancellation after 30 days: Prorated refund based on the remaining term of the warranty, minus any claims paid and an administrative fee.

To request cancellation, contact customer service by phone or email. Refunds will be processed within 30 days of the request.

  1. Renewal and Transferability
  • Renewal: Customers can renew their warranty plan before the expiration date. Renewal rates may differ from the original purchase price.
  • Transferability: If you sell your golf cart, the warranty can be transferred to the new owner. To initiate the transfer, the customer must contact our support team, provide proof of sale, and pay a nominal transfer fee.
  1. Customer Responsibilities
    To maintain the validity of your warranty plan, customers must:
  1. Follow proper maintenance as outlined in the golf cart manufacturer’s guidelines.
  2. Report issues promptly to the Company to prevent further damage to the cart.
  3. Maintain accurate records of maintenance, repairs, and modifications.
  4. Notify the Company of any change of ownership or transfer of warranty rights.

Failure to adhere to these responsibilities may result in claim denials or voiding of the warranty.

  1. Payment Terms
    Payments for warranty plans must be made in full or according to an agreed-upon installment schedule. Failure to pay on time may result in a suspension or cancellation of coverage. Customers with payment issues should contact customer support to discuss available options.
  2. Dispute Resolution
    If a dispute arises regarding coverage, claims, or services, we encourage customers to contact our customer service team to resolve the issue amicably. If the dispute cannot be resolved, the matter will be submitted to arbitration under applicable state laws. Arbitration is final and binding for both parties.
  3. Limitation of Liability
    Golf Cart Warranty Company is not responsible for any indirect, incidental, or consequential damages arising from the use of the warranty plan. Our liability is limited to the cost of covered repairs, part replacements, and associated labor as specified in the warranty plan.
  4. Indemnification
    By using our services, you agree to indemnify and hold Golf Cart Warranty Company harmless from any claims, damages, or expenses related to the misuse or unauthorized modification of your golf cart or NEV.
  5. Privacy Policy
    We respect your privacy and are committed to protecting your personal information. The data we collect is used solely for the purpose of providing warranty coverage, processing claims, and enhancing customer support.   6. Changes to Terms and Conditions
    Golf Cart Warranty Company reserves the right to update, revise, or modify these Terms and Conditions at any time. Customers will be notified of any significant changes via email or by posting the updated terms on our website. Continued use of our services constitutes acceptance of the revised terms.
  7. Governing Law
    These Terms and Conditions are governed by the laws of the state in which American cart Care Company is headquartered. Any disputes will be resolved under the jurisdiction of that state.
  8. Entire Agreement
    These Terms and Conditions constitute the entire agreement between the customer and American Cart Care Company. They supersede all prior understandings, agreements, representations, and warranties, whether oral or written, regarding warranty services.
